Chapter 9 - Civil jury trials in the High Court

Introduction

Many people, including members of the legal profession, are unaware that parties to a civil dispute may have their case heard by a jury, provided certain criteria are met. Civil jury trials are rare in New Zealand now, so in considering the consolidation of the courts legislation it is necessary to consider whether legislation should continue to provide for trial by a judge and jury in civil proceedings, and, if so, in what circumstances.
